Did you know that starting January 1, 2024, there are important updates to the Notice to Employee form (Labor Code section 2810.5)? The California legislature amended the employee notice requirement this year with the approval of SB 616 and AB 636. SB 616 increases the minimum amount of paid sick leave that all employers are obligated to provide. Additionally, in accordance with AB 636, agricultural employers must now include a clause in the new Notice to Employee requiring them to notify employees of disaster declarations within 30 days of the employee’s first day.
What does this mean for employers? You must begin providing the amended Notice to Employee, which includes the Emergency or Disaster Disclosure and the new minimum criteria for paid sick leave. Furthermore, you must notify your employees in writing of any changes to the information in the notice within seven calendar days of the changes occurring. Considering the new paid sick leave requirement, for example, if your business previously front-loaded paid sick leave and subsequently decided to transition to the accrual system in the new year, you must provide written notification to all employees within seven days of the change.
